© 2013 Copyright. All Rights Reserved
Copyright is a form of protection provided by the laws of the United States (title 17, U.S code) to the authors of "original works of authorship" including literary, dramatic, musical, artistic, and certain other intellectual works. As stated  at copyright.gov. 2 examples of what would constitute "copyright" is copying a few sentences from the newspaper and using it as your own to publish a story.

Fair use is any copying of copyrighted material done for a limited and “transformative” purpose, such as to comment upon, criticize, or parody a copyrighted work. Such uses can be done without permission from the copyright owner. In other words, fair use is a defense against a claim of copyright infringement. If your use qualifies as a fair use, then it would not be considered an illegal infringement. For example as an artist I would use fair use to compare the work of an artist to my work and examine the differences.

The situation with Shepard Fairey he pleaded guilty in February to criminal contempt of court for falsifying and destroying documents and coaching a witness while embroiled in a copyright infringement battle over his use of a now-famous image by The Associated Press that featured then-Sen. Barack Obama. The court made Fairey pay $25,000 in fines in a dispute that dates back to 2009, when he brought a federal lawsuit against AP, claiming that he was entitled to use the image under the fair use doctrine, according to a statement by the U.S. attorney for the Southern District of New York.

The public domain is generally defined as consisting of works that are either ineligible for copyright protection or with expired copyrights. Public domain works and information represent some of the most critical information that faculty members and students rely upon. Public domain works can serve as the foundation for new creative works and can be quoted extensively. Creative  Commons is a nonprofit organization that enables the sharing and use of creativity and knowledge through free legal tools.
